Nursery fined Rs 50,000 for not replacing dead plant

A nursery owner in the district has been fined Rs 50,000 by the consumer court for causing mental distress and legal expenses to a customer by refusing to replace a dead plant. A K Sardana, presiding over the consumer court, has sent a copy of the judgment to the Union secretary and the Haryana government. They have been advised to seek necessary guidelines from the central consumer protection council or relevant authorities regarding the registration of plant nurseries under the Shops and Commercial Establishments Act. Additionally, it has been emphasized that plant nurseries should not supply plants and other products without issuing a cash memo.

The complainant approached the consumer court on August 8, 2019, alleging that they had purchased 15 different plants for Rs 3,000 from OP Nursery in Jind. However, one of the plants was already dead and the nursery refused to replace it.
